Commissioner of Oaths
Associate and Fellow Members of CGISA have been granted the designation of Commissioner of Oaths as published in Government Gazette No. 39641, No. 83 dated 29 January 2016
CGISA has undertaken, on behalf of the Minister of Justice and Correctional Services to establish and maintain a register of all members who choose to use the Commissioner of Oaths designation. Likewise, should you decide at a later stage to stop using the designation of Commissioner of Oaths, you are required to notify CGISA.

Under section 7 of the Justice of the Peace and Commissioners of Oaths Act, 1963 (Act No. 16 of 1963) (“the Act”), a Commissioner of Oaths may administer an oath or affirmation or take a solemn or attested declaration from any person.
The regulations governing the administering of an oath or affirmation require the Commissioner of Oaths to follow a specific procedure to fulfil his or her duties, which are detailed below:
Administering the Oath
An oath is administered by the deponent saying the following:
“I swear that the contents of this declaration are true, so help me God.”
An affirmation is administered by the deponent saying the following:
“I truly affirm that the contents of this declaration are true.”
Before administering the oath, the Commissioner of Oaths must ask the deponent:
- Whether he or she knows and understands the contents of the declaration
- Whether he or she has any objection to taking the prescribed oath
- Whether he or she considers the prescribed oath to be binding on his or her conscience
If the deponent affirms the above three questions, he or she shall then sign the declaration in the presence of the Commissioner of Oaths.
Below the deponent’s signature, the Commissioner of Oaths must certify that the deponent has acknowledged that he or she knows and understands the contents of the declaration, specifying the manner, place and date of taking the declaration. The Commissioner of Oaths shall sign the declaration, print their full name and business address below their signature and state his designation and the area for which he holds his or her appointment.
A Commissioner of Oaths shall not charge a fee for administering any oath or affirmation or attesting any declaration. A Commissioner of Oaths shall not administer an oath or affirmation relating to a matter in which he or she has an interest.
